MILITARY COURTS, (MALAY PENINSULA

A Proclamation to establish military courts for the administration of criminal law during the period of Military Administration.

I,

General Officer Commanding Military Forces, Malaya, in exercise of the authority conferred upon me by the Supreme Allied Commander South East Asia Command, DO HEREBY PROCLAIM

PART I

INTRODUCTORY

Short title and extent.

1.

This Proclamation may be cited as the Military Courts (Malay Peninsula) Proclamation and shall have effect in the Malay Peninsula.

Interpretation.

In this Proclamation

"Assessor Court "! means a court, constituted in accor-

dance with section 4 (3) of this Proclamation, consist. ing of a President of the Superior Court assisted by two assessors;

"British Officer Court" means a court, constituted in

accordance with section 4 (2) of this Proclamation, consisting of a President of the Superior Court sitting with two officers of the British Naval, Military or Air Forces;

"confirming authority" means the officer having the

power of confirming a judgment or sentence; ..

"Court" means any court established under this

Proclamation;

"President" means a President of the Superior Court

established under section 3 of this Proclamation;

"Presiding Officer" means the Presiding Officer of a

District Court established under section 3 of this Proclamation;

"written law" means

(a) the written law of the Straits Settlements as

regards the Settlement of Penang and the Settlement of Malacca;

(b) the written law of the Federated Malay States as

regards the four Federated Malay States and the written law of any one of such States as regards that State;

(c) the written law of the State of Johore, Kedah,

Kelantan, Trengganu or Perlis respectively as regards cach such State.
